These terms govern the sale and use of the Connect IQ applications ("the apps") sold by Cubio AS, organisation number 925 322 504 MVA, registered at Fridtjof Nansens veg 43, 2816 Gjøvik, Norway ("Cubio", "we", "us"). By purchasing or using an app you agree to these terms, our Refund Policy and our Privacy Policy.
Several of our apps are published on Garmin's Connect IQ Store. Some of those can also be bought here, so the same app may reach you by either route — what decides which terms apply is where you bought your copy, not which app it is.
If you bought on the Connect IQ Store, the commercial sections below do not apply. Your contract of sale is with Garmin, not Cubio. We are not the seller, Paddle is not the Merchant of Record for it, there is no activation code and no Cubio licence — Garmin's own terms govern the purchase, the delivery and the refund. Our Refund Policy says the same. If you are unsure which you have: a purchase from us came with an activation code by email, and one from Garmin did not.
What does apply to every app we publish, however you obtained it, is Acceptable use, Safety and liability, Warranty and Governing law below, together with our Privacy Policy. Support is the same address either way.
For apps sold on this site: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's own buyer terms apply to the payment transaction in addition to these terms.
Each purchase is a one-time, perpetual licence to use one app on your own Garmin watch. There is no subscription and no recurring charge. The licence is personal and non-transferable except that you may move it between your own watches as described in the app.
Paid apps are activated once online: on first run the app asks for the activation code from your purchase and binds the licence to that watch. After activation the app runs entirely offline. The licence entitles you to activate the number of devices stated at purchase (one, unless stated otherwise).
After payment you receive an activation code by email and a link to the installer, which copies the app onto your watch over USB. Delivery is electronic and immediate; no physical goods are shipped.
You may not resell, redistribute, sublicense, or share the app package or your activation code, nor attempt to circumvent the licence or activation mechanism, except to the extent such restriction is prohibited by mandatory law.
WARNING: The app is intended only as an in-flight aid and should not be used as a primary information source. If the app contains a barometric altimeter, it will not function in a pressurized aircraft and should not be used in a pressurized aircraft.
The apps are recreational in-flight aids and are not certified aviation instruments. They must never be used as the primary or sole source of information for any flight-critical decision — including, but not limited to, navigation, altitude, glide range, landing-site selection, and terrain or obstacle clearance. The pilot in command remains solely responsible for the safe conduct of every flight. This notice forms part of these terms — read it before use.
Every reading and calculation the apps show is an estimate derived from a consumer smartwatch's sensors. It can be inaccurate, delayed, or unavailable, and must always be cross-checked against certified instruments and the pilot's own judgement.
The apps read the watch's built-in barometric altimeter but do not calibrate it. Before every flight the user is responsible for calibrating the watch's altimeter and barometer through the watch's own settings — this is done outside the app, which cannot do it. An uncalibrated or drifting sensor produces wrong altitude and climb readings.
The apps are provided "as is" without warranty of any kind to the extent permitted by law. Nothing in these terms limits your mandatory statutory rights as a consumer. Subject to those rights, Cubio is not liable for any indirect or consequential loss, or for any loss, injury, or damage arising from use of the apps.
Refunds are governed by our Refund Policy and handled by Paddle as Merchant of Record.
These terms are governed by the laws of Norway, and disputes are subject to the Norwegian courts, without prejudice to any mandatory consumer protections of your country of residence.
We may update these terms; the version in force at the time of your purchase applies to that purchase. Material changes are reflected by the "last updated" date above.
